Cavalry Portfolio Services

I was bored, so I decided to see who Cavalry actually was, and it looks like I hit the nail on the head from this entry.

From their website:
...one of the largest buyers of distressed debt in the United States...

It's still one of those things that my brain wants to spell as Calvary for whatever reason (see previous post).

As i type this i am going thru the same thing with Winn & Sims and bunch of blood suckers. I went to court, the judge said i wasn't given proper notice and took the matter of calendar. I guess i was supposed to file an opposition, what is an opposition? Anyway, a few weeks later i get more papers, minus the opposition, with a new court date. That's pretty sad, if that's all you can do after going to school for 4 years.

Bunch of ass holes.

I had a car with a finance company and the car was totaled in 1995. The insurance to my knowlage had paid the car off. As it turns out there was a balance of 33.00 owed. This Cavalry company now wants me to pay 188.00 which includes intrest. It is now 10 years later. This is the First I hae heard of this or I would have paid it 10 years ago.

Cavalry is a VERY BAD company..They called me about a debt that I owed to SPrint and I made a 100.00 payment over the phone..In return the interset on the account was to be frozen because I set it up were once a month they would take out 75.00 but they first had to send thepaperwork to me to get the okay...I have not gotten the paperwork yet and it has been about 3 months later...I have called and called and the person that handles the account NEVER returns my calls...I am on the phone right now with the company and I have been holding for 40 mins and counting...I hate this company..They are a poor excuse for a business...

Calvary Portfolio is a stupid company who doesn't investigate before collecting. Sprint turned a collection over to them that wasn't even in my name and put it on my credit report. I wish there was someone I could personally call and curse them out for doing this because I have to go through all of the hassle of getting this removed from my credit report when I never even owned a Sprint phone. Sprint and Calvary can go straight to hell and both will be hearing from me in the future.

My name is randy from Houston Texas. Sprint also turned two sprint accounts over to Cavalry for collections in my name as well. I have no knowledge of the sprint bills. I have disputed with everyone; however, the bad news is still on my report as my wife and I try to purchase a home, What do I do?

I received a new phone line and then the recorded calls started to come in from a Heather Kelly, after calling them back several times I guess they went home and I was given the opportunity to leave a message for Calvary Portfolio Services? This company needs to be reported.

Who is this damn company? these dumb jerks has put me in collection over a sprint bill that was opened that I wasn't aware of, meaning IT'S NOT MINE!!! But the killer is, aren't they suppose to contact you before they try to ruin your credit? fair debt collection laws state so. Oh, well time to get busy.

I was a Marine serving overseas in a combat zone for 9 months in 2003. I left the payment of my Providian Visa card to my wife to take care of while I was away. Long story short, wife cheated on me the whole time I was away, spent all the money I was sending home on drugs and clothes, and I came home to nothing. Now Cavalry is harassing my parents for money because I don't have a phone line where I live. A $250.00 debt has grown to $746.00 debt. Thank you Cavalry for all you do for our men in uniform and compassion!

I have had a recent problem with them. I paid an AT&T bill to AT&T. A month later i got a collection bill from cavalry. The only way to solve it is go to www.bbb.org it's for the better business bureau. They can work numbers. Now i have them kissing my ass!

I need you all to know something....cavalry is a bottom of the barrel collection company but they are feeding off of peoples ignorance about the law. Each state has a statue of limitations on debt collection. For example, an open end account, which is like a credit card in PA the company has to charge off your account after so many months of inactivity. Once that happens the clock starts. In PA there is a 4 year statue of limitations. You do not have to pay that debt after 4 years. These companies buy these from the person you owe the debt to for a very small amount then try to get the full amount from you!!!! Please know your rights. Each state has a different statue of limitations and you can find them on the web by doing a search. They are trying to collect a debt from me from 12 years ago and I told them the law and requested that they don't call me back and they started yelling at me. If they call again I will turn them into consumer relations for harrassment.

I started receiving phone calls from "Heather Kelly" at Calvary Portfolio shortly after getting a new phone number. I'm asuming the last person who had this telephone number owes someone some money, because I sure as hell don't. I have spotless credit.

Anyway, I decided to have fun with Cavalry owing to their incompetence, and I would encourage you to do this too: Call 1-888-568-0073, and you'll often get their voicemail box. Leave a funny and insulting message, and then you'll have the option to leave it a BUNCH of people's voicemail boxes. Just press "#" on your phone and you'll get their telephone directory. You can search for group voicemail boxes.

This company HAS to be incompetent if their voicemail system is so easily hacked.

I have never in all my life heard so much crap from lazy, stupid, and oh its not my bill blah, blah, blah file it w/insurance, its not mine, crap,that is ridiculous, cavalry is not a bad company, u people are just pissed off because deep down inside your sorry souls you know that you owe this money unless proven otherwise. how pathetic of you people to criticize one of the best collection agencies in the world. If you didnt owe the bill you never would have been contacted in the first place. they got me with sprint. originally the bill was 59.00 through many contacts with sprint and the bill changing hands 3 times i was not able to catch up with them, now in the hands of Cavalry (Ruthless services) im fighting a 4 year old battle concerning early termantion fees..and a bad credit mark God help anyone facing Cavalry

First of all I am not stupid nor lazy. I have spotless credit also but when I was in college a credit card company decided to give an 18 year old college student with no job a credit card. Needless to say I had to chose between eating or paying the credit card. You are an uncaring cold harded b*tch. Most debt collectors are. I am sure that everyone on here is a hard working adult that at one time made a mistake or two so who are you to judge? I'm sure you have made a mistake in your life so don't pretend to be better than everyone else. People like you make me sick. I too at one time was a debt collector but I was patient and caring. I collected over 1 million dollars in 6 months from past due accounts. Now I help people for a living and it is so rewarding instead of praying on people that are down in their luck.

I received a collection bill on an AT&T wireless phone which I paid in 2001 in full. I even have a letter from the company that states it was paid in 2001 in full. I faxed it to this inept company twice and they are still trying to collect. They are impossible to deal with and will not coperate. I asked them to fax me a letter stating they received my documentation and they refused. They are screwing my credit on an account that was paid over 4 years ago and have the documentation that states that and they are still persuing it. I spoke with my lawyer and am thinking about sueing them for their dishonesty and corruption. Things like this ruin your credit and cause monetry and mental damage. If I can't get a car loan, house loan, any loan or even a job because everybody checks credit they are responsible for this personal damage. So please if any one thinks they have a good case answer to my post and I may form a civil lawsuit. Thanks!

Someone said that their husband works for Cavalry and that we are a bunch of whiners ... Well they just called me to pay a bill of $1154.56 to Sprint. I have NEVER had Sprint services. I pay 100% of my bills on time. We have never lived at the previous address that they had for us. This is absoutely not a bill that we owe! We did not incur this debt. All I can say is that this is FRAUD.

Today, June 8, 2005, my father who is 84 years old, received a call from David at Calvary Portfolio. He proceeded to tell my father that he did know a Keith A.... He called back twice more, even though there is no such person at this address. He called my father a lier and insisted that both of us knew this Keith person. I think that Calvary just goes through the phonebook and calls anyone with the same last name. It sounds like most of you got called because of a Sprint phone. I have never used Sprint and certainly won't now!
To the wife of the Calvary collector...There are too many complaints for this to be just a coincidence. I go with the majority...Calvary is an unscruplulus (sp) company. I have reported them to th Better Busniness Bureau!

They cannot call and harrass me for a debt that is not mine.
I keep getting these pre-recorded messages left on my home phone from a lady called HEATHER KELLY. This is harrassment.
I just did a Google search on that phone # that is left on my voice mail 1-888-568-0073 and stumbled upon this page here.
I also checked them out on the Better Business Bureau web-page and I have learnt that they have had several complaints filed against them.
Now, I know I am not the only victim
I am reporting the matter to Better Business Bureau as well.

All of you sound like you could use some help (especially Mr. and Mrs. Debt Collector---jeez!).

Read the Fair Debt Collection Practices Act:
http://www.ftc.gov/os/statutes/fdcpa/fdcpact.htm

Also find your state's debt collection rules and read those.

Make sure to always, always, always get everything in writing and keep a record of everything (the messages they leave for you, their number on caller ID, etc.) If they are verbally abusing you, you should look into recording the conversation (check the law on this, though).

Also, another tip is to complain to the credit bureau. They have to respond to your complaint within 30 days, and they might be able to help you get this sorted out.

To the woman who claims that her and her husband ar edept collectors. STUFF IT! I settled with Sprint over 4 years ago and have been contacted about this alleged "debt" I owe. They say I have to settle it with Sprint.
I say BULL. It's not my responsability to contact anyone. My dept is settled and that is THAT.

Today June 13, I received a very scary phone call, they were asking for my husband and would not give me any information of where abouts they were calling from. This man only wanted me to write down a number and to relate the message to my husband to call back before 10 pm tonight because if he did'nt, they would take legal action against him. Of course this really made me nervous. I am very sensitive to stress and being diabetic it affects me. My husband and I have triyed calling them A.S.A.P. but no luck. After finally understanding the pronounciation of the voice mail, I decided to do some research over the internet, and what a surprise! I read all your guys comments...what a bunch of @#$%$#^, I will immidiately go to the our local credit bureau and do some digging my self. And if these buch of assholes are trying to darken our lives with their bunch of BS, I will take my self LEGAL MATTERS! God Bless you all and thank you for putting up your comments (leaving out the stupid family that works for these fools), this will surely help us tell them off when they call again!

To the person that posted the comment about Calvary threatening Legal action. It is illegal for any collection agency to threaten anyone with imprisonment or anything of that nature. You may want to contact the trades commission and another website that you may want to check out is Bud Hibbs. I went through a similar situation with a different Collection agency. They went as far as impersonating a law office and said they were affiliated with the FBI and that If I did not pay a certain amount of money by a certain timeline that they would arrest my husband. Well after I got done with the BBB and the Federal Trades Commission as well as contacting the Florida Bar association to verify whether or not the man that called me was a lawyer practicing in the state of Florida that company has never bothered me since.There are a lot of collection companies that have lawsuits against them for practicing illegal means to gain payment.It is also illegal for them to call after a certain hour and they cannot call your place of employment if they know that your employer does not approve.They cannot discuss your account with anyone else either other than the one that supposedly incurred the debt. And they cannot force payment out of anyone other than the debtor.

I checked my credit report and found a cavalry portfolio service on in delinquent, and I didnt know wh they were, My credit score went from a 760 to a 693 because of this for , get this $ 19.00, I called them and they said it was a Union 76 card, I have never been late or missed any payments , ever, they looked into it, and said it was when Conoco bought Union 76, and in between the merge they took all balance due and gave them over to them for collection, even though they were never late or in bad standings. So I called then and got a Jonathan on the phone at 800-724-1757, he looked into it and said he would call all three credit companies and take it off, the thing is I never got a call or a letter from this Cavalry, so I never knew and in the mean time it affecteed my credit, that I worked hard to maintain, it has been three days and Johnathon still hasnt done what he said he would do, my next strp is contacting my attorney and suing both Cavalry and union 76, over a 19.00 mishap that never occured, come on 19.00, if I owed it I would pay it, but It is not even owed my balanc ewith Union 76 has always been in good standings for over 5 years, says so even on my credit report. So fight this company if it is a mistake, but if you owe it pay it.

to the person that their family members are being harassed by cavalry the one thing that I would recommend doing is sending them a Cease communications letter make a copy of it before you send it and send it certified where they have to sign for it verifying that they have recieved the letter and then if they still continue harassing you take it up with the Federal Trades Commission and even though someone may or not be a debtor if the collection company is in direct violation of the fair debt and collections act they can be fined for each occurence and could owe you money.

I work at Calvary Portfolio in Saint Paul, Minnesota.

I am reading your posts, and I have to say... you have the wrong impression of Calvary.

This place stresses legal integrity. There are many, many other collection agencies that would treat you a lot worse.

You realize that everyone has a legal right to dispute every debt that they have. If you don't owe the money, then you don't have to pay and the bad credit mark is erased from your score (see "Brady Bill"). If you do owe the money, then you should be paying what you owe. If there has been any kind of accumulated interest or fees, then as with any bank, you can negotiate and get some of those charges dropped.

Don't be mad at the company for doing thier job. They are trying to be a profitable business.

-however, if they harass you, or treat you with any kind of disrespect; then you need to ask to speak to a manager.

Where I work (Minnesota), it seems that everyone there is good stuff. You must be dealing with another branch (New York, Tulsa, or Tempe).


- And come on, let's be realistic. If you are going to complain about how collections are being done you should be reading up on the laws (FDCPA) which are made to protect the debtor (customer). If you don't like how it's done, then you should be writing to your representative to get the laws changed. Cavalry has a strict policy on following the laws.

I work for cavalry portfolio services in tulsa, oklahoma.

Listen, Cavalry is a good company. Our training and meetings prohibit lying or verbal abuse. If you encounter lying or verbal (yelling)then ask for the resolution manager who is always near by.

Cavalry employees will never impersonate FBI or law enforcement as this is a violation of FDCPA.

Cavalry employees are taught to treat you with the utmost respect- but we realize that there are con- artists and ghetto people that are basically thieves. We struggle everyday trying not to insult and harass the eldery, SSI recepients and the disabled.

If you recieve a call then talk to the account officer- most will either work out a deal with you or disposition the account to make it go bye- bye so that our legal/ compliance office in hawthorne, ny can decide if it goes back on the floor or if they will pursue them after our ASSET INVESTIGATION the AO is doing while reviewing the available info.

We are not TELEMARKETING so do not call lists do not apply to us.

We are not harrasing anyone- if a debt is owed it is our right to collect it since we bought the right to do so. People who dont think so are acting like the neighbor who thinks you are harrasing him because you are wanting your lawnmover or tools back that he borrowed.

The assumption is-
1. If you dont answer the phone or return the calls after a couple of attempts then you probably know its a debt collector and are probably guilty
2. If multiple messages are left with a live person and you dont return the calls then you are not being an adult and being responsible.
3. We feel if we mail the paperwork for ACH or other agreement then it should come back within 72 hours by mail or fax- we can resend on request.
4. No mail PAYMENTS. "the check in the mail" excuse is always discussed in our training.
5. Work the negotiation- give the customer a great deal every time.
6. If a customer is 'jerking you around' you get it approved for legal. Maybe the customer will come back to the negotiating table if they get served? Doesnt hurt to try this...

Anyway, poss paid prior account? You need to be a responsible adult and keep all your paperwork and bill statements. If you sent us a statement, police report or any any docs we treat them like gold. Always fax these papers!!!

REMEMBER: You may be an ASSHOLE too if you talked to 2 good reasonable people all day and everyone else was an asnwering machine, screener or some 'jack'.

I have been receiving these phone messages for the last month and decided to investigate the number 888-569-0073 and "Heather Kelly". This is the only site I could find.

1. My husband and I have faithfully paid all our bills over the years (30) and have outstanding credit.

2. I will not return the calls ever. The previous message from an employee that people not responding because they owe is incorrect. I simply never respond to this crap.

3. We have NO outstanding debt to anyone. This company is in error. I have not ever received any notice through anyone about any debt.

I'm commenting here to simply add to leaving a trail of poor business practice by this company.

Does anyone know if contacting my phone company with harassment complaint by this company would be of benefit?

Im a Cavalry employee...

If you dont respond to our calls to at least explain yourself or resolve a dispute then you are not being a responsible adult.

I answer all my phone calls- I'm not afraid to answer my calls or return calls because I have grown up.

Police dept cannot help you stop any calls. Calling the phone company cannot help you. We are not telemarketers so "do not call list" does not apply. If you refer to attorney we will ask the attorney if "he is paying the bill for you".

You want calls to stop? Talk to the a.o. when he calls and explain the situation.

Fraud? Then you need to go to police station and file a police report. Ask a.o. for compliance dept number and order a fraud packet. Fill out fraud packet and place the case number in the paperwork. We will work with detectives to investigate fraud 'for you'.

Have you paid your debt off in the past? Get your paperwork and fax it to us or send it through mail where we have to sign for it.

Send written or faxed letters with all other requests or statements if you prefer not to talk directly with your account officer. Most letters will be read and filed directly by the a.o. in charge of the account.

This is 'not' a precise business- but if you dont owe it then as an adult you should 'prove it' and go through the correct procedures.

Running and hiding is not responsible. If you can post on here and 'tell it like it is' then give us a call back.

CONTACT CAVALRY BY MAIL OR BY PHONE OR HAVE YOUR PARENTS CALL AND STATE THAT YOU ARE NOT AT THAT ADDRESS.

CAVALRY DOES NOT DETERMINE INTEREST- THE SMALL PRINT ON THE FORMS THAT YOU PEOPLE SIGN UP FOR ON CARS, HOMES, C.C. AND CELL PHONES DETERMINE WHAT THE DEFAULT INTEREST FEES AND CHARGES ARE. SO, IN THIS CASE THE INTEREST DETERMINED FOR YOUR DEFAULTING ON THE LOAN WOULD HAVE BEEN PUT IN TO ACTION ORIGINALLY BY PROVIDIAN.

Cavalry is a VERY BAD company..They called me about a debt that I owed to SPrint and I made a 100.00 payment over the phone..In return the interset on the account was to be frozen because I set it up were once a month they would take out 75.00 but they first had to send thepaperwork to me to get the okay...I have not gotten the paperwork yet and it has been about 3 months later...I have called and called and the person that handles the account NEVER returns my calls...I am on the phone right now with the company and I have been holding for 40 mins and counting...I hate this company..They are a poor excuse for a business...

Our answering machine has been getting calls from "Heather Kelly" every day for months on end. My wife and I screen our calls and we typically ignore calls like those from "Heather" since the person refuses to at least identify what company or organization they represent of even mention who they are trying to contact. I finally tried to call "Heather" back on Saturday to see what "non-business" information was so important and got her message that the number was for Calvary Portfolio Services. Gee the name sounds like an investment company to me so I was eager to call "Heather" back to inform her that we are on the do not call list and ask her to stop calling us.

I decided to do a Yahoo search before actually trying to contact "Heather" and I'm glad I found this site before actually calling Calvary back. My wife and I check our credit report on a regular basis and we are not aware of any outstanding debts we owe especially any more than a year or two old. If someone thinks we owe them money, they are more like to get a response by sending us a letter not some anonymous phone call.

I would speculate that these calls are for our cousin who lived with us for several months and used our phone number as a contact.

I just tried to go to www.calvaryportfolioservices.com to see if this so called company has a web site and access was blocked by my employers web filters. The kind of site they won't let us access are:

after asking repeated ly to be left alone and they called back telling me that my letters were never recieved .if the debt is in despute that should be all there is to it , but they want to play games on the phone and wonder why people yell and hang up on them and now harrass to point of calling back to get angrier even, sprint seems to be the main account for these people if i owed it i would pay but service was not provided. agreement was not kept by company there.calvary do your home work on your so called debts before you harrass people.

Let Cavalry explain this to them. This is a service few people take advantage of even though we pay for it in our taxes. I suggest you all do the same.

I don't know why I feel the need to add yet another case for the record here, but add me to the list of victims. I, myself, have a Sprint account in good standing. My husband has a phone on my account, which (need I repeat?) is in MY name. We have had this account for quite a few years. His name, however, was chosen in the infamous Calvary Lottery and we began receiving "offers" to pay a supposed less than owed amount (because they are such angels of mercy?). I saw that the account they associated with this debt was Sprint (I hadn't paid any attention to whose name the debt was assigned just yet). I thought that it was odd to get a collection from Sprint when I hadn't noticed any discrepancy in the bill that I had paid recently. Long story short, they claimed that my husband had a phone with Sprint for 5 months. He has never had an account in his name. So now, they want us to prove that he didn't incur the debt. Just how exactly is that going to work? You can't prove a negative. Duh! The burdon of proof should be on them, since they want this money. Prove that my husband set up, received and used an account with Sprint. While you are at it, explain why, if he had this service for 5 months, did he never receive a bill? Never a late notice? Nothing from Sprint at all? Only, all of the sudden there is this collection action being taken? Prove it.

Calvary Portfolio is a stupid company who doesn't investigate before collecting. Sprint turned a collection over to them that wasn't even in my name and put it on my credit report. I wish there was someone I could personally call and curse them out for doing this because I have to go through all of the hassle of getting this removed from my credit report when I never even owned a Sprint phone. Sprint and Calvary can go straight to hell and both will be hearing from me in the future.

First of all I am not stupid nor lazy. I have spotless credit also but when I was in college a credit card company decided to give an 18 year old college student with no job a credit card. Needless to say I had to chose between eating or paying the credit card. You are an uncaring cold harded b*tch. Most debt collectors are. I am sure that everyone on here is a hard working adult that at one time made a mistake or two so who are you to judge? I'm sure you have made a mistake in your life so don't pretend to be better than everyone else. People like you make me sick. I too at one time was a debt collector but I was patient and caring. I collected over 1 million dollars in 6 months from past due accounts. Now I help people for a living and it is so rewarding instead of praying on people that are down in their luck.

I am a christian collector. I have 'no' debt because I dont fall into the 'trap' of 'wanting'. i pay cash for everything except the house and the utilities. i drive paid off vehicles. i did not get student loans in college, but preffered to work my rear off after transferring from junior college.

your in denial.. stop spending on those credit cards and getting pay-day loans and financing those big cars.

after you contact an attorney he may
1) charge you several hundred just to write a 'strong letter' to cavalry which will do no good in the long run

2) start a case that may cost you several hundred more than the actual debt was in the first case.

if the attorney is not going to pay your debt personally for you then you are wasting your time and money.

if you owe the money then pay it. if you dont then dispute or file fraud that we can investigate along with your local authorities.

Today June 13, I received a very scary phone call, they were asking for my husband and would not give me any information of where abouts they were calling from. This man only wanted me to write down a number and to relate the message to my husband to call back before 10 pm tonight because if he did'nt, they would take legal action against him. Of course this really made me nervous. I am very sensitive to stress and being diabetic it affects me. My husband and I have triyed calling them A.S.A.P. but no luck. After finally understanding the pronounciation of the voice mail, I decided to do some research over the internet, and what a surprise! I read all your guys comments...what a bunch of @#$%$#^, I will immidiately go to the our local credit bureau and do some digging my self. And if these buch of assholes are trying to darken our lives with their bunch of BS, I will take my self LEGAL MATTERS! Wow! The things I see. I feel for all of you people here! I definitely feel for the debt collector and her husband. As if it isn't enough to harass these people for a job-you can't get enough of it at work so you come home and go after them even more! I too have recently been contacted by Cavalry. They have not contacted me once in writing regarding my so called debt!!!! Instead they decided just to serve me! My guess is they some how got my bank information showing a decent balance in my account. Oh well....

For once the collector is going to lose and lose big! I have already settled this account with a previous purchaser of the debt. So I will be showing up in court in less than a month with my HIGH POWERED AND PRICED real estate attorney/ bankruptcy attorney. I will also have my proof of payment with the previous firm stating the account number and the fact that it was paid in full! I can't wait to see the look on their face when the judge awards me my fees, lawyer fees, loss of wages and the like. If they don't pay then they will be subject to the worst!

I will keep you up to date!

By the way...for little mrs. do gooder and her husband I would be careful as the Fair Debt Collection Practices Act, Fair Credit Reporting, FACTA, ECOA and others explicitly stae that the use of profanity when dealing with debtors is expressly prohibited and can result in a $ 1,000 fine per occurence. In fact, you are not even allowed to bad mouth people! Which you did! Read the law IDIOT! The law does not limit the restraint from cursing and bad mouthing to mailed correspondance. It states in "any" communication which this blog is and most are Cavalry Customers!!! You may have just racked yourself for $1,000's.

Anyway, I know you and your family are perfect and never have had debt, hard times, a mistake on your end or anothers! Way to go be a good Christian. Got a call from Cavalry today. This guy asked for my wife by first name, as if they were friends and then would not respond to my inquires as to who he was and/or the nature of his call and/or his relationship with my wife. Instead, he chose to disrespect me by asking me the same questions back. I hung up on him, went to the caller ID and then to the internet. Had this guy been a "responsible adult" and responded to reasonable questions asked by a man who is speaking to another man asking for the first man's wife, then maybe the process could have started to resolve this perceived debt.
Now, after reading all this stuff about this "fine" company and knowing what I encountered this morning, they can just kiss my ass and bark at the hole!

I was a victim of identity theft sometime in late 96' or 97'. Luckily, one of the major credit companies noticed suspicious activity recent credit activity and contacted my legitimate address. (There was a new fake address being used on these credit reports.)

I immediately informed them that this was a fraudulant application. They advised me of other recent inquires by other creditors. I subsequently contact all other creditors the received fraudulant application or opened fraudulant accounts.

I diligently reported this activity to the credit report agencies and police department. A fraudulant warning was added to my credit reports. However, in 96' police reports were not made on identity theft.

In December of 2004, I received a message from a Salvatori Spinelli's Law Office regarding a Calvary Portfolio account. I immediately returned the call and was informed of a Unocal 76 account that I never had. I immediately told them about my identity theft incident and that the account was never reported on my credit reports. They told me to send a dispute letter, which I did that very day.

After a month of not hearing anything from Calvary, I contacted their office again. I informed a new person regarding the situation, they had no reference to my previous call, and claimed they never received my letter. They however promised to send a fraud package for me to fill out. I also sent another letter regarding my dispute.

Guess what!!!! I never received the fraud package. I therefore sent two other letters dispute the debt. Never received any response or fraud package. I am now applying for a refinance and there collection action appears on two of three credit reports. My broker tells me that my credit score without the collection action is 760 and the others with the 670. He was amazed how one collection account on the credit report dramatically effected the score.

I therefore called Calvary Portfolio again...They then referred me to a different attorney. I called that attorney...He referred me back to Calvary....I called Calvary, and they promised to send another fraud package.

I know they have violated the Fair Debt Collection Practices Act and the California's Fair Credit Reporting Act by failing to valideate the debt. A violation carries a statutory damage of $1,000 per occurrence.

I wasn't going to pursue the damages....However, I am now apply for a refinance. If they do not correct this matter soon, I will have no choice but to sue for the statutory damages and the value of the lost refinance.

If the person that is making comments regarding peoples stories could help, I would appreciate it. (P.S. I did not check this for grammar or spelling!)

TO MAKE SURE NOTES OF YOUR PHONE CALL ARE MADE CONTACT THE CAVALRY EMPLOYEES AND NO OTHER SOURCE AND MAKE SURE THEY MAKE NOTES WHILE YOU ARE ON THE PHONE TO THE ACCOUNT. CAVALRY CANNOT, HOWEVER MAKE NOTES TOWARDS THE ACCOUNT IN ANY WAY THAT WOULD HELP YOU IF THE ACCOUNT HAS BEEN SOLD OR TRANSFERED TO ANOTHER PARTY SUCH AS AN ATTORNEY OFFICE, COLLECTION AGENCY OR SOLD TO ANOTHER PARTY.

I WOULD SUGGEST THE BEST COURSE OF ACTION TO BE CONTACT TRANSUNION, EXPERIAN AND EQUIFAX YOURSELF TO DISPUTE THE ITEM. THEY IN TURN WILL WORK WITH YOU TO REMOVE IT WITH CAVALRY OR THE ENTITY THAT IS ACTING ON BEHALF OF CAVALRY.

REMEMBER THAT WHEN CONTACTING A CREDIT AGENCY TO SEND ALL PAPERWORK REGARDING YOUR DISPUTE OR YOUR INVESTIGATION INTO THE FRAUD. KEEP A COPY OF DATES AND PAPERWORK SENT FOR YOURSELF.

My father has recently been going through the Heather Kelly phone calls - leaving messages and trying to call Heather back at the designated times - with no luck and no response. I did an internet search for the phone number and came across this blog and told him about it. Since they had personal info stolen from an attorney's office a few years back we've checked their credit reports annually. And, when they became free in our state this year I pulled them up - nothing was listed on them. My parents have no debt and have never had any late payments or bad credit. My dad called Sprint when I told him what I had found and since Sprint had no record of past debt they gave him the following general number for Calvary to call to find out what was up. The number is ... (800) 429-0535 Turns out the phone number my dad has was listed under someone else's name - they have supposedly updated their records and we hope this is over. A couple of suggestions for Calvary: (1) Have a live person make the calls and if no one picks up then click over to a recorded message - in my dad's case this would have ended the problem a month ago; (2) Whichever employee of Calvary is responding to the bloggers on this site ... should remember they are supposed to be representing a legitimate company and therefore should be showing a little more restraint and professionalism in those responses.

I think what the broker is saying...The credit reports have the same information except two of the three have the Calvary Collection action reported. Those two have an approximate score of 680, while the one without the credit score is that has the same credit information 760..... Based on reasonable deduction, he came to the conclusion that the collection action is making the biggest mark.

Additionally, I had previously gone through a refinance on a seperate property the two years before, with no calvary reported on the reports, and the average score was 750. I guess his crystal ball is deduction....

ONCE AGAIN THE PROBLEM WAS SOLVED WITH A SIMPLE 'PHONE CALL'. I AM NOT TRYING TO SOUND SARCASTIC BUT TRYING TO GIVE LIGHT TO THE FACT THAT BEING AN ADULT AND HANDLING YOUR PROBLEMS HEAD ON CAN SOLVE ANY SITUATION.

In these days of 'buyer beware' we all as consumers have to understand that the claims of 'I've never had a .... account' or 'that's not me' are some of the most common excuses that debtors use with collection agencies. Therefore, we also have to understand that in many ways it is our responsibility as a consumer to prove it is NOT our debt, rather than the agency's issue to prove that it is. The sad fact of the matter is, the agency has the upper hand, and can with very little documentation, get a judgement against a consumer simply because of unwillingness of the consumer to cooperate with any investigation. Cooler heads prevail - calmly explain that you believe the debt is not yours, and ask for the steps necessary to clear this situation up. Again, the irate claims and ranting only lead the collectors to believe that you are simply angry that a debt collector has finally caught up to you, and the vicious cycle begins. Collections is not a pretty business, but most agencies are very careful to stay within the law to protect themselves. Be adult, and be prepared to resolve the issue calmly and carefully.

Back in 2002 I purchased a cell phone from Sprint. The phone worked for a month, before it would not even turn on. I kept paying the bill for 5 months even though the phone was useless because Sprint kept saying they would turn it back on after the next payment. I stopped paying for the phone, and they turned me over to Calvary for collections. I refuse to pay for a phone that didnt work. As I see it, Sprint owes me money. Calvary doesnt even have documentation of my contract. What a bunch of ASSHOLES!!!!

my wife recently received a letter from cavalry for collecting $1100 bill (in 2001) purchased from sprint. however, she never use sprint service and has never received any bill from sprint. she filed police report in our locate station. a dispute packet just arrived. however, the company requires her to submit copies of her social security card, driver's licence, and evidence of residence together with the dispute form. it also states that they have the right to sale personal information to third party. i have difficulty to understand why they need all these documents which can be used for other fraud. as a private bussiness, do they have the right to ask for these documents? or is this the common practice for a debt company.

I have just been reading all these comments. It is crazy and I do see both sides.
When someone works for a collection agency they do have to be aggressive but still be professional. Alot of people don't have that talent.
They do get the blunt of the attitude from the debtor, but yet they still should be professional.
Yes, everyone is responsible for paying there bills on time. Yet things do happen. With the world changing all the time, no one knows what tomorrow brings. We still must do the right thing.
Collection companies are not always right, because they are going off what the lendor sent them. It may not be the right info. I beleive the Collection Company should verify prior to contacting the debtors. That's not always the case. Alot of Colletion Agency have alot of young people working for them that are not mature enough to handle this. I know this because we have one here in our town that my sister worked for. They do have a high turn over rate because they can't get qualified people to work there. Probally because the starting pay is only $7.00 an hour. My sister quit because she got a better offer making twice the ammt.
I do beleive people try to avoid the Collection Agency because they don't have the money or they prefer to have other things. It's not right. You do have those that have been reported by Lendors to the Collection Agency incorrectly. What I mean, one # off on a SSN #, looking at several accts and sending the info for the acct in good standing to the Collection Agency. THey don't realize what they have done, until it's at a level with the Collection Agency.
This is why I feel for those who are complaining. When someone states you have rights, you can appeal, and etc.... THat is bull.
If someone is trying to get a house and finds a colletion on their report that wasn't on it a month ago, than that's a problem.
Than this person can't get a house until it's fixed. It can take a month to years to get it fixed. Than it gets fixed and the find out the Collection Agency or the Lendor screwed up. But the person trying to get the house has to suffer for someone elses misstake. That isn't right. These should get fixed asap. Who's to pay this person for his/her time proving he/she didn't owe this debt. An apology isn't good enough. I know this happens because of my sister working at a Collection Agency and some friends I also know.
I also wanted to comment on those who work for this company that made comments.
Some have been very professional and loyal to this company.
Some have replied to several comments by using CAPS, which in the professional world means yelling, not be professional.
Some claim to be Christians but say alot of ugly and hateful things to those who have made comments. That isn't Christian like behavior and you should read your bible front to back. Check out judging, and how Christ acted.
Know that ugly remarks are negative and you can not gain anything positive back from what you say. When you offend someone the bible says you should apologize. I see many that this person has offended. I apologize if you think this is to harse. I beleive you have only made the company look even worse by your replies. It's not professional at all. You should have said something like what the other company employees said. If you are a Christian, than you should at as Christ did. The bible says we all come short of the glory of God. So just because you say your're a Christian doesn't mean you'll get to heaven. YOu have to live it daily not part time. Be Christ like. I wish everyone the best and hope all can we worked out professionally.
Remember:
Company employees should always be respectful for the indivual and professioal at all times.
Debtors should work out something to get your bill paid and keep all statements,letters, and etc... as proof it was paid. Check you credit report mthly so you can be on top.
For those that know or beleive they have notified in error. Know your rights and don't be fooled. Get it taken care of asap. Time waits for no one. I hope that everything get worked out. Records from lendors have show proof of your signature that you signed. If they have none than the Collection agency has no grounds other than word of mouth. They usually have something and must provide you with that info that led to them contacting you.

Good news!!!!! Yesterday, I got off the phone with the fraud manager at Calvary Portfolio and the agreed to close the collection account and remove the marks from my credit reports.

FYI, I was the person who was a victim of identity theft around 1997 and had attempted to get this matter resolved for months. Finally, I will have a perfect credit again...Yippie!!!!!!!!!

Just thought I'd let you know the outcome of my ordeal.

Yikes...my credit report has now been affected because of this company. I contacted Sprint directly to dispute the bill. I finally received a letter from Sprint verifying that they made an error. However, I have to contact the bureaus myself to take their mistake off my report.

Folks...was researching info about Calvary Portfolio and feedback. Boy, did I find it on this web-site! Many of the comments concerning Calvary and others is justified. But again, I'd like to point to the law and your rights as a consumer. You and I have rights and I encourage you to use them. Many of those collection agencies today are in fact chasing folks down on debts that MAY NOT be collectible. (They are banking on your ignorance of the law)

On this site I read comments about a person, presumably a wife who indicated that her spouse worked for Calvary Portfolio. She indicated that the company as well as her husband , in summary are good folk - but she couldn't spell or even create her sentences correctly. (Point: can she really make an assessment)

In summary...
Collection agencies and firms bank on one's lack of knowledge. Research the laws both for your state and check the consumer web-sites for factual information. Don't stress the small stuff and since most of that stuff comes off your credit reports by year seven,don't worry. (Learn from your mistakes!)

If you want to collect a debt, you should really allow people the convience of some sort of modern payment plan. I cannot stand this company, they should be reported to the better business bureau

Ok well I was pissed at this Cavalry company also. They charged my husband almost $300 for Sprint for a phone he has NEVER had. The only cell phone company he's ever used was Nextel. But he filed with the credit bureau and the company saying it was fraud. I just called them to pay it off cuz we're both annoyed at not being able to get credit and they said it had been closed and we didn't have to pay b/c it was fraud. Now all I can hope is that guy wasn't full of crap and this will all get resolved. We'll see...

I just recenlty pulled my credit report and saw I appartenly owe sprint bill as well. I did have a sprint phone more than 5 years ago. A few months ago I get this letter saying I still owe this money. I swear on everthing I had paid this bill. So I called them they were not that helpful they ket thelling me that I never paid instead of investigating. I know for a fact I sent the bill to sprint. Then 7 years later I hear from this company. According to the credit report I still owe I couldn't believe it. I had called sprint and they said the account was paid in full and never sent to collections. I guess I will be calling them agian tomarrow becouse someone is lying to me and I want to know who. Also why is that most of the complaints here have to do with sprint pcs? How are they even still in business

I turned my home phone off becouse I was getting harassed 5 to 10 times a day. I had gone thru the police filed for phone harassmant(which didn't help much)and went thru the phone company to file harassment. Appartenly miss Wilson owed cavalry money. Guess what I'm not miss Wilson. I decided to do a search on this company that kept calling my house and this is the only site I could find. I even checked out the web address listed on this page and still nothing. Too all you empolyees of cavalry stop trying to make yourself sound better than us. we all make mistakes. It sounds like most of you hate your job. well find a new one. Instaed of trying to put down people you don't even know. I went thru a nightmare of a time trying to explain that I wasn't miss wilson. No one ever said life isnt full of choices,Do your best to make the best choices that you can. Choose your credit lines very carefully. I think one of the hardest lessons learned with credit is that is truly defines a person in this day and age. Credit cards are the enemy, dont be in such a hurry to buy now what you can save for and if it can't wait, than borrow from someone you are likely to payback a brother sister mom friend family member etc..When you are matur enough to make credit decissions you won't have multiple cards that are tens of thousands of dollars past due, furthermore regarding some of the issues like cell phone bills read your contract and stay with one provider your whole like everyone who ever had a disconnect with a cell phone had a final bill and most likely wasnt a fair bill. It's a tough world out here protect your credit and if your worried or not wanting to pay your drbt than don't borrow any money!!

being a loser myself i find it extreamly irrating when someone calls me to pay a bill that i have long ago decided to not pay. I just cannot belive that someone would call me, me-a completly irresponsable person who can barly dress myself much less have any finanical or social responsablity, to pay on a "bill". I've tried everything, lying to them telling them that i was dead, not home,changing my number, and having my kids answer the phone and carefully training my 6 year old to screen my calls because i lack the spine to get on the phone and actually communicate with the scary person on the other end - hopefully i can teach my 4 year old to lie and decieve people as well so he can grow up to be a functional part of society just like me.

You don't need a lawyer to sue Calvary services. Keep good records of all your information, document, document, document and look up your state's law on credit collections. Yes, they have big time lawyers, but the lawyer's scare tactic works on 85% of all the people, so they will do this to you. Remain calm, search your state laws, keep detialed records of your interaction with calvary, once you find out where you stand with your state law, you can file suit, or you can wait to have them sue you and file a counter claim and present your arguement on their court bill. If you are in the right, you will make some money and they will pay all the fees. I'm no lawyer, so do your homework, but my quick search shows that my state has penalties for collection companies that don't verify the person's contact information or for wrongfully trying to collect a debt from the incorrect person. Let them keep calling, I'm making an hourly wage from them now... until they sue some guy that is not me... and they finally listen that I am not him and that they are sorry for causing me so much pain and problems. Thank you Judge, will be my final word.

Cavalry send me a collection letter Re: Sprint account for $562.00. Account was set up in 2002 with my name and SS#..I have never had an account with Sprint (or never will in the future). I requested verification of the account from Cavalry (sec. 809 Fair Debt Collection Practice Act, FTC and haven't had a reply. In the meantime, Cavalry reported this false debt to the credit agencies...I have filed a identity theft with the FTC and the 3 major credit agencies...I have to go through all of this because Sprint didn't do their homework when someone used my name and ss# BUT HAD A WRONG ADDRESS AND CITY! Cavalry should also check the validity of the debt and NOT REPORT IT TO THE CREDIT AGENCIES WITHOUT NOTIFICATION TO THE VICTIM( me in this case)> Hope others of you with similiar cases will check your rights and ask for verification before giving Cavalry any information....good luck!

Over the last couple of months we have been getting automated calls from Calvary looking for a Mark Pennington. I DO NOT KNOW A MARK PENNINGTON! My wife selected the option for no Mark Pennington at this address several times. On July 26, 2005 I was rudely awakened by one of these calls. My caller ID showed 877-896-0010. I called and spoke with a real jerk that finally said he would remove my number. Today August 5, 2005 I received another automated call! I again called 877-896-0010, got the name of the company, talked to a Wayne Mercer, and was again told that my number would be removed. I have now noticed that a message was left on my Call Notes on August 3, 2005. This company obviously does not listen to people that do not owe money, so I can see where they would not work with those that do! I am now documenting my communications with Calvary and strongly suggest that they do not call me back.

Now ill say this my $25 bill owed to sprint was lagit but was also paid to sprint and the paper work was faxed just as anonymous asked but was denied and they wanna charge me $185 for a 8 year old bill. well guess what im not paying $185 and the statute of limitations is up so this greedy company that is trying to collect out of date debts can shove it. Some time ago, I had 3 cell phone lines with Ameritech Mobile Communications. About 6 months before the end of my contract, they turned ALL of my numbers off claiming that my phones had been "cloned" and were being fraudelantly used in other parts of the country, thus.....I'd have to get new numbers. I was extremely upset since I had had these numbers for a number of years, but I needed my cell phones bad, so I went in to an Ameritech Agent to get my phones re-programmed, and they put 3 new 2 yr. contracts in front of me to sign for the new numbers. I explained I'm not signing any new contracts since I was very dissatisfied with their service and would most likely be leaving them in 6 months anyway.

Again, they refused to reprogram my phones unless I signed the contracts.
I told them I wasn't signing anything..........and we left it at that. Within weeks.....I started getting bills for "cancellation fee's"! I called them and explained to them, that THEY were the ones who turned off my phones, I didn't cancel them and they were very insistant collecting this fee, as if I just cancelled my service out of the blue!

After going back and forth with their corporate heads at Ameritech, I thought the problem had been resolved.....however YEARS after the fact now, I have some moronic collection agency (Calvary) hounding me for these bills (supposedly from AT&T now).

They've also now put a "public notice" on my credit bureau this morning! I'm fed up with these company's and their "extortion tactics".

They called me a couple of times and I asked them to PLEASE take me to court. I guess they figured I'd cave in if they dinged my bureau!

If I owed the money......I'd pay it.

Owning a collection ageny is a crap-shoot. I guarantee the person who owns Calvary gambles heavily.

They buy a company's supposed "bad-debt" for pennies on the dollar and hope their extortionists can turn it into $$$!

I have had the unfortunate pleasure of being harressed by this company. They keep calling me and it is not I that they want. The person they are calling does not live in my home. I have asked this company to remove my phone # , they keep telling me they have and then a few hours later their auto dialer calls me again. They were upset up with ME because I RAISED my voice at them
So far I have talked with Michele, one whose name I can't find and Nicholas ( who is a supervisor) and most recently with Fred. They all LIE. I was told if you listen to message on the autodialer you can remove your # when you hit the # that is to tell them the person does not live in you home...not so another 6 calls after doing so..in fact today after yelling at Nicholas (who was very upset with my attitude) told me he removed my #, I received yet another call from them not even 2 hours later. This time Fred was upset with my attitude. Please Nicholas and Fred please explain to me why I should be pleasant to you after weeks of asking you to remove my # and telling you the person does not live here.

My mother started getting phone calls from "Heather Kelly" about six months ago for a SPRINT account my deceased father never had. After making numerous calls to the company, I finally got Cavalry to provide me with the last four digits of the social security number on the account. Those numbers did not match my father's! Cavalry assured me we would be removed from their list. Two months later, I got a bill in the mail from them. Again, after several calls, I filed a complaint with the Attorney General's office in my state. Just got a letter back from Cavalry's legal folks, via the AG's office, saying we have been "officially" removed. Let's see what happens. I at least have documentation if something happens down the line -- bad credit, continued calls or mail, etc. By the way, I documented every phone call to Cavalry (dates, times, individuals talked with, etc.). This helped me provide detail to the AG and share the "different" stories I got each time I called. I would suggest you fight them every step of the way if you didn't have or don't remember having such an account or past debt! I can say they were very rude and unprofessional with me every time I called.

my husband had an old sprint account. for 4 years we were not contacted on how much he owed the company and when we called sprint themselves no one wanted to help. so then out of the blue we start recieving phone calls from cavalry portfolio services. now my husband is in iraq so i pay the bills and take care of these type of phone calls. Most of the time i get someone on the line that i can not understand because the accent is so bad. and one time i recieved a phone call from a man stating he was from this company, he had kids yelling in the background and then asked if he could call me back when it was better for him. they call me probably 3-4 times a week even though a payment arrangement has already been made. and to top it all off they call me on a sunday. how rude is that. according to my knowlage they aren't supposed to call you on sundays. so i do belive that this company does work in shady ways. and it should be investigated and be closed. most bill collection places make sure that the information is correct before they start calling. but i quess not these people. i suppose they have nothing better to do. so to all the rest of you i sympithize i know what you are going thru and the sad thing is the debt was only $172. all of this BS for that. Unreal. and as far as the lady and her husband that works for this company i feel sorry for you and your family. you are not christians. and i can surely bet that the bill collectors call your house too. cause no one is perfect. even though some think they are. and for the person that says you need to be a grown up and answer you phone, when you have someone that calls and harrasses you all the time i wouldn't want to answer the phone either not to mention maybe this company should get some people that speak with out so much of an accent and learn to listen to the people that they are calling.and it would help if they weren't so rude on the phone when they are talking with you. i will be make a complaint to the better business beurou because of this whole situation. sorry that my spelling wasn't all correct. thanks for listening to my complaint.

I am commenting to this person's post... I too am in that boat. Only mine is one that thier claim is to a Conseco Classic Credit Card of which I have never owned. I have sent my own C/D letter and have had three others sent by attorney's. The calls and letters
no longer come but the postings on my CRA's continue and have been there for the full 4.5 yrs. There is interest or something (I have yet to fully figure how they have come to that fact) added each and every month.

I have never had validation from the company nor any proof that this so call debt is mine.

In the beginning when they got the 1st set of C/D letters from me/attoneys, they tried to turn the accounts over to CAPITAL MANAGEMENT . . WHO is another off branch of the same company only in Chicago I beleive. I sent them back with the comment that I would not deal with a 3rd party collector. And If Calvary is just that themn when the C/D letters were sent then they should have sent those so call debts back to the original companies. That is the law. But as we have all found out that Calvary does not like to play by the rules and as the Do by OLD Old out of date Debt they will try all they can to get you to pay and friends once you start that clock ticking again then it is you pay and pay.

Do go and read BUD HIBBS at BUDHIBBs.COM. This Site has been good but he has some good suggestion that will help.

Just remember they mainly buy up old outdated debt, large past due portfolios and not all the info they get is good. . in fact most of it is not. If they can scare you into paying then they will. . and make more monies off your old $19.00 from whatever that companies name was had long written off, Whatever most likely wont see any of that monies anyway.

Document everything, keep good records and watch your back. Listen hard keep you kool and let them trip themselves up. . you can record them to but be sure what you state allows 1st.

I have been fighting them 4.5 years and we do not have to prove to them that the debt is not ours.. . unless you have paid it off and can do so but to some of us who question they have to show is validation of the said debt not just thier word. Something on paper is the best way. And thus far as far as my sitution is concerned there has been no paper work sent this way except something demanding M O N E Y !

I faxed it to this inept company twice and they are still trying to collect. They are impossible to deal with and will not coperate. They are screwing my credit on an account that was paid over 4 years ago and have the documentation that states that and they are still persuing it. I spoke with my lawyer and am thinking about sueing them for their dishonesty and corruption. Things like this ruin your credit and cause monetry and mental damage. If I can't get a car loan, house loan, any loan or even a job because everybody checks credit they are responsible for this personal damage. You can write Calvary a letter, attach the proof of payment and place a cc at the bottom of the letter to the 3 Major Credit Bureaus and the Better Business Bureau. Then send a copy of the letter and the attachments to the 3 major Bureaus. The credit bureau will investigate and if they do not receive a respons in 60 days, they will remove it from your credit report and send you an updated copy.

I'm so dang angry w/ Cavalry and it seems as though a bunch of people are. I'm not trying to "blow off" my debt; I'm trying to take care of business. I have called and called Cavalry several times and have left several messages for them to call me back. Not ONE person has called me back. In fact each and every time I call the number that I'm directed to call they say that their office is closed and the normal business hours are from 7am to 8pm. Well, I EVERY SINGLE FREAKING time I have called I have called well within those hours. I know for a fact that if I decided not to pay this bill they would be hunting me down like a dog. I just want someone to call me back and let me know the status of my account!!!! Is that so hard??!! I don't know about anybody else, but at my job if I do not call someone back I don't only have the customer to answer to but I also have my bosses to answer to. I do not like answering to people so I just try to do my job. And I wish I could talk directly to Mr. & Mrs. debt collector because maybe her husband could turn on his little computer and turn off their voicemail and answer a simple ass question. Instead I get to sit here and try to figure out who on this planet to I make a complaint to that will actually get me result? If anybody knows the governing company of these blood sucking, incompetent, stupid, LAZY, assholes I'd really appreciate it!!!!!!!

I just went to the BBB site for AZ and Cavalry has a very very bad reputation. I'm going to try to get in touch with them 1 more time. After that I'm going to the BBB and find out how to make a formal complain with their governing entity. I suggest everybody do the same.

I finally got intouch with Cavalry and they said they are charging me a 21% interest. I told them that was totally unacceptable and I called Sprint PCS and they are showing that I owe about $60.00 less than the original bill. I told Cavalry that I am going to take care of my debt through Sprint direct and stop dealing with them and their unethical practices. Cavalry informed me that even if I paid Sprint PCS direct that I would still have to pay the insterest at 21%. I called Sprint and they said I did not have to pay the 21$ interest rate, they said that if I fax them proof of all of my payments to Cavalry they would apply the dollar amount to my actual total due. I'm now looking into filing a complaint with the FTC. I'm under the impression that they are not to charge more than the actual amount due or more than the terms and condions of the origional loan. I believe Cavalry lies and from what I'm finding out from the FTC that is really bad and my result in a fine. The lesson I have learned is not to deal with a collection agency over an outstanding debt, but to contact the actual company and deal directly with them. I will be filing a formal complaint with the FTC....which by the way, the guy at Cavalry said that they do not have a governing agency...I told him he was full of it when every business has a governing agency through the federal government....what a dumba$$!!!!!

Out of nowhere,I received a bill from Calvalry saying I owed a bill to sprint for 1,067 dollars. We have never had Sprint. I called them and told them so. They said they would send us fraud papers. On the Fraud papers they sent us they asked us for our social security numbers, copy of license, etc. I do not know who Calvalry is, never had a sprint account, so I did not know who I was sending all my personal information to. I called Calvalry and asked them how did I know who they were and how I did not know if they were going to steal my identity etc. since I knew we did not owe this debt. This overpaid,ignorant $%#@ said I could call the attorney general and hung up. I filed the paper and forgot about it. Now we are trying to refinance our mortgage and guess what is on our credit report? We are now trying to dispute it and the only thing to do is to go through the three credit bureaus. Now I read this web page and am horrified to see how many people are victims of this bully organization. We will fight them tooth and nail. We do not owe this money.
And to MR. and MRs. Douche bag debt collectors: YOu are too good to be trailer trash. And Most people who claim to be so "Christian" are the most UN Christian people I know.

can you explain why when I am trying to take care of my debt they are charging me a 21% interest rate? That was not part of my deal. When I called Sprint direct they said if I pay the debt directly to them then they will not charge me a 21% interest rate. Tell me how that is legal when on all of the documentation that Cavalry has sent me states nothing about charging me interst. Tell me why the rep misinformed me of what would happen if I delt directly with the company I was in default with. I'm trying to take care of my debts, but do not want to get screwed in the meantime. And to be honest with you, some people have situations which cause their credit to fail...it's not always within their control due to personal circumstances!

Ode to a Professional Bill Collector:

Let me start off by saying that I am a bill collector (and proud of what I do). I serve many roles in my job from advisor to employment consultant and have helped many people deal with problems that they have seen as insurmountable or as simply a nuisance.
Generally speaking, people should pay their bills. There are many reasons they don't, such as loss of income, unexpected emergencies, mistakes or actions that cause financial burdens, laziness or the desire to cheat someone out of something to name a few. However, the worth of a person is NOT measured by his ability to pay their bills OR getting others to pay a bill.
Collection agents as a whole are no different from any other portion of society. At times they act honorably and at other times they act shamefully. Most agencies are middle of the road: a job must be accomplished while staying within the guidelines of federal, state and local laws.
Then comes the bottom feeders in the collection process: bill collectors whose sole purpose is to demean, cajole, badger, harass and even cheat people to meet their own needs, whether it is earning a paycheck or thinking power comes from being hurtful to others. From inside information I have regarding SOME of the operations of Calvary, it would not surprise me if the FTC puts them out of business. If you have legitimate complaints against them, let the FTC know. Go to http://www.ftc.gov/ and click on file a complaint at the bottom of the page.

This is to the guy that USED to work for Cavalry, because I believe I can get a much better answer from him than anybody else. So what you are saying is the 21% interest rate they are just pocketing hopeing that I'm stupid enough to keep paying that without doing anything. I just looked up Texas Law and it expressly states that they are not to charge me interest. 1 other thing...other than the FTC where else do I go to complain about this. I already have a solution to my immediate credit issue by dealing directly with Sprint...but in the meantime, I really didn't like being raked over the coals like that. I'm a single Mom of 2 kids with no child support...I need all the pennies I can collect and if I can do something that can help someone else later then I want to go through with that. I would appreciate your feedback.

Texas law has provisions that provide for deceptive trade practices (adding interest unlawfully could be considered one) whereby the verdict allows for three times damages of the actual amount. I know him, I don't like him, however he is very good at what he does. If you talk to him, mess with his head and tell him the ghost of Curtis sent you.

RE: I need you all to know something....cavalry is a bottom of the barrel collection company but they are feeding off of peoples ignorance about the law. Each state has a statue of limitations on debt collection. For example, an open end account, which is like a credit card in PA the company has to charge off your account after so many months of inactivity. Once that happens the clock starts. In PA there is a 4 year statue of limitations. You do not have to pay that debt after 4 years. These companies buy these from the person you owe the debt to for a very small amount then try to get the full amount from you!!!! Please know your rights. Each state has a different statue of limitations and you can find them on the web by doing a search. They are trying to collect a debt from me from 12 years ago and I told them the law and requested that they don't call me back and they started yelling at me. If they call again I will turn them into consumer relations for harrassment.

Almost everyone on this site is bashing Cavalry Portfolio Services, well I have something positive to say about them. I am not an employee (they are the only ones that have something positive to say). I have two AT&T bills one with Cavalry and the other bill with someone else. Before my bill was sent to Cavalry AT&T was offering me settlement offers as low as 35% but I could not pay them because I didn't have the money. I spoke with Jaime (ext.24525) and she was very helpful and understanding. She helped me get the $495 settlement offer again (instead of paying the full amount of $950) and even broke it down to payments. So for those who are having problems with all the other reps contact Jaime. Maybe she will be more professional than all of the rest. By the way, THANKS!!! to the person who posted the phone number.

By the way, for those who work at Cavalry Portfolio Services who are posting these messages, you guys know how to contact each other managers or something. If you read all of these messages the majority seem to be about Ms. Heather Kelley! This chick really needs to be fired!!! So maybe you guys need to do something positive for your complaining customers and report this chick to your supervisor. I mean, these people have some dirt on this lady and she's making your company look really bad. Take the advice! This company probably have so many complaints, they'll be shut down in a couple of years and you collectors will be out of that "good paying job"(quoted by the no heart woman) and looking for another gig.

This company has called me three times in 2 days and my ex who is on the old bill 8 times in 2 days. They have called me threatening my family and trying to make my husband believe that I am a naforious character and he shouldn't trust me. I never had a chance to call them and talk to them when they called Immigration and told them I was fleeing the country becuase of my debts. Thankfully it did no good becuase I have been working on my immigration documents so that I can be with me husband and kids long enough for them to know me and know I am safe. In the mean time, these people can go to hell. It's not even my debt. I admit I cosigned 5 YEARS AGO! Why havent I heard anything since! I wasn't the one who let the house go!

During a terrible divorce 6 years ago, I became unable to pay my bills. I accepted responsibility even for the bills my ex owed. However during the divorce, thanks to some shenaningans on my ex husband's part. I had to leave a $60,000 job and was unemployed for 36 months. Needles to say..my credit rating went down the toilet. Since his shenanigans have hurt my ability to get a better paying job. I have been making $20,000 per year since. 3 years ago Cavalry called...and since I do pay my debts I agreed. They have been deducting $50 every month. I don't get statements from them at all. Well today on Labor Day, I find out they doubled the agreed upon amount to $100. Shock to me...I don't know why or what is going on!

You need to file a complaint to the Federal Trade Commission and then contact your states Attorney General's office. I personally have contacted www.deanmalone.com and told those attorney's of what Cavalry is doing...maybe you can coontact them with your story. Maybe every body that is having a coomplaint with Cavalry can contact Dean Malone and maybe they can launch a class action law suit or something. But in Section 808 of the Fair Credit reporting act it does state that they cannot collect more than what the original loan was. (They are charging me 21% interest). Also contact all 3 credit reporting agencies and let them know what Cavalry is doing.

I am a collector for Cavalry. I would like to address a few of the previous postings on this site. I am not here to insult you. I am actually happy to see there are people out there who wish to educate themselves about the company and how to handle their debts. First, FDCPA DOES allow interest charges. It does state that you can not be charged more than what is owed, but what is owed includes interest. What they can not do is tell you your bill is $550 when it is actually $500 WITH the interest. Second, THERE IS NO TIME LIMIT ON HOW LONG A DEBT IS COLLECTABLE. What a statue of limitations dictates is the length of time you can be persued LEGALLY for repayment (I.E. Garneshments, accounts being frozen, leins, etc.). A debt is owed and can be collected on until the end of time. I have personally collected on debts that are older than I am. Third, as far as collection companys go, Cavalry is one of the best. There are many individuals that break the law and they are delt with. By in large, however, Cavalry takes great measures to try and make sure that does not happen. We are under constant observation and many people have lost their jobs due to breaking the law. What most of us do may not be fair or moral, but it is NOT illegal. Fourth, collections is not a "Below entry level job". Collectors make more money than most other professions. I personally have a degree in business and I chose to work in collections because it does pay so well. Many of my co-workers are the same way. A decent collector will average $35,000 - $40,000 a year (In Tulsa that is a very good living, if you want to compare that would be like making $60,000 - $80,000 in California or New York). A good collector can make $60,000 to $100,000. Fifth, you do NOT have to be contacted about a debt before it can be reported on your credit. Companies are required to contact you in writing either before or within 30 days of calling you. Before I get slammed for what I am saying, please keep this in mind. I am not trying to prove you wrong, just trying to educate you on why we do what we do. Make no mistake about it, we are here to make money and we make a lot of it. Every business is in business to make money. That is just a fact of life. Hating the company calling you about a debt YOU created does not solve the problem. In most cases you have the right to be angry and upset. We purposely irritate and try to get an emotional repsonse. That is the only way some people will pay back money they borrowed. Please keep in mind, however, the irriatating measures we take would not be nessesary if the debts had been handled the right way from the begining. We would not be able to buy distressed debt if people paid it the right way. The Sprint accounts are very flawed, we know that. Sprint is a horrible company and I do not recommend that anyone do business with them. Some information is wrong but they can be resolved if you talk to us and work with us rather than trashing us anonomously on a blog site. The worst thing you can do is ignore your debts. You credit is one of the most important things to maintain for a healthy and happy future. One bad account will no ruin your credit, but one bad account can lower your credit score enough to cause a higher interest rate on home and car loans. For example, a credit card with an unpaid balance of $1000 can lower a score 20-30 points. You home loan interest rate would then increase .25%. Over a 30 year loan that small change on a $100,000 loan will cost you $5000-$7000. You are paying for it one way or another. If you had talked to the collector about the $1000 they probably would have settled the account for $750. Which would you rather pay? I do agree that their are some collection companies out there that are ruthless and heartless in what they do, but not all of them. The vast majority of collectors and companys are very honorable and strait forward as long as you are honorable and strait forward with them. You start playing games and hiding from them, they are going to come down on you hard. They all have teams of lawyers.They know what they can do legally and what they can do without breaking FDCPA.

Calvary generally does not do any reaearch on the debts they claim to buy. They are tring to collect from me for a name that is similar but not exaclty correct, at an address where I never lived and know nothing about, and for a product that makes no sense for me to have. When I tell them this and ask for a copy of account statements and a contract they tell me to have a good day and hang up. Calls start back up a day or so latter. Is this fair?
If you have a similar situation just tell them you will go get your records, put down the phone, and see how long they will hang on. It will waste their time and money since no calls are free. Don't bother to argue p- it i pointless. Don'task for a manager. They are worse then the lowlife collection agents. There is not much else you can do with people like this. If they have not sent you anything in the US mail it is because they have nothing but some computer listing from a company that is even more sorry than Calvery. It is not likely they could win anything in a legitimate US courtroom without a copy of a vaild contact with your signature. I am an attorney and am quite certain of that. I would really likely to go to court with them, but I don't think I will ever get that opportunity.

I got to this blog after trying to figure out who keeps calling and leaving phone messages.

They are doing the same thing to me as others. I have never received a statement or bill about a debt. I have never even talked to a person because it is always a recorded message telling me to call them. I tried twice but went on hold, waited, andwas then told to cal back later. I work in sales and marketing and we would never treat a customer or client like that. If they think I will call back they are crazy. I also like the idea of calling them up and leaving messages with # to a whole group of people or putting the phone down if you get a person.

I just wanted to comment about the guy with the "business degree" who works for Cavalry. I hate to tell you that statute of limitations means after the statute of limitations rounds out then you are shit out of luck. meaning, if you had an auto accident you have 2 years to file that claim and collect damages if you wait longer than 2 years the insurance company and the courts are just going to tell you see ya. Rape has a statute of limitations of 4 years although I do believe that they changed it to a 2 year statute of limitation once they are able to identifiy the perp. But the point is...debt collection is no different than any other incident. And you made me laugh out loud when you said that you are happy that we are "trying" to educate ourselves. Because if you have read the samethings that I have read then you would see that Cavalry is boldly disrgarding the law! Not only that....My debt with Sprint is $322 and I do have a bill from your glorious company in the amount of $386. And when I have called the wonderful people at Cavarly, managers included they were as rude as you could get. They couldn't explain why they are charging 21% interest (I have gotten 3 different answers on that question) and they were supposed to send me my payment history (I have yet to receive that). And you know you can get more with honey than vinegar meaning ya'all don't have to be assholes...you state that if the consumers would just talk to you and try not to avoid you then you would treat them with respect. Well, look at it this way...You are calling their homes try treating them with respect. Some people just don't have the money to pay back...is that bad yes...but does it happen of course. But I do not think that harrassing people or try to get an emotional response out of someone like you stated is going to help matters. I do not think that a company charging someone a 21% interest rate and not be able to explain why is exactly ethical and you even stated youself in the example you posted about the misbilling being illegal and I'm a victim of your very unethical company. To the recent post after Sandy. Good points but it doesn't matter. I like the comments by "Put Cavalry Away" I think it is worth a try. I am a Real Estate Attorney and a Class Action Suite is too difficult in this case. I am on this board because my wallet was stolen over 8 years ago and the thief has been able to order phones giving my ssn. The phone companies don't check, but are quick to give the account away once the debt gets over $500 and a year or two. I have been harassed for over 6 years and can do little except hope they take me to court. In my county they will be dismissed within 5 minutes after the opening statements. I will counter sue for time, costs, and aggravation and get maybe $5000 and they will pay all court costs but its not worth it to me. I think we should turn the tables and see how we can annoy and disrupt them. You will fill much better when you see how a blog put a collection agency into the deep blue sea.

I sent registered letters for almost 2 years to Cavalry Portfolio disputing a $100 dollar Sprint debt. They never validated the debt and the CRA's they reported to "verifies" the debt through an automated system. I sent them proof repeatedly along with telephone numbers of people they could talk to at Sprint about this bogus debt. August of this year they finally sent the "debt" back to Sprint ang guess what? Sprint found their mistake from 3 years ago, and gave me free services this month for their mistake.Guess what? Cavalry sold the debt back to Sprint in February 2005, yet was still reporting it. I called and left messages repeatedly @ Cavalry to no avail. After finally threatening to sue them under the laws of the FCRA (I have retained all of my registered mail receipts)I finally got a return call. Funny...when they ARE WRONG you can't get them on the phone... Kim @CPS said "it will be off of your credit in 72 hours." I was sent a free credit report showing that it had been removed. So... Cavalry EMPLOYEES...there are people out there who have debts on their credit that don't belong to them. Your company is not perfect and spends too little time investigating possible mistakes. It should NOT take 2 years to fix a mistake.

One of their tactics is to make it difficult to dispute a debt. They do not send anything in writing to identify themselves or the details of the debt. Yes, I do have a business degree. Part of having a business degree is 6 hours of business law. There is a difference between criminal law (I.E. Rape, murder, assault) and tort law (I.E. auto accidents, DEBTS). The statute of limitations in every case is designed for LEGAL REMEDIES. If you rape someone and charges are not filed for some years, the legal statute may run out for criminal charges, but you can still hold them liable in civil court. Before you tell me I don't know the law, you should learn it yourself. You are VERY wrong about what you think is the law. I do this for a living. I know FDCPA backwards and forwards. A DEBT IS COLLECTABLE UNTIL THE DAY YOU DIE AND SOMETIMES EVEN AFTER THAT. WHAT WE ARE DOING IS NOT ILLEGAL. This blog site is a perfect example of why we talk to people the way we do. I tried to post information you can use and again you want to try and make excuses for not wanting to pay your debts. Also, your interest rate is what it is because of the contract you argeed to with whatever company your debt was with. For most Sprint accounts, the default interest rate PER YOUR SERVICE AGREEMENT is 21%. If you are not familiar with a default interest rate, that is the interest rate that you are charged when you default on the account (when you don't pay). It is usually higher than your account interest rate. This is perfectly legal. Every credit company has this included in the agreements you sign with them. Just take a look a credit card application. I never said we were illegally billing you. I said SPRINT made some mistakes. I do not work for Sprint. I have no affilation with Sprint. They had some problems due to large amount of non paying customers they have. When we purchase the accounts, we have to go through them and figure out what was right and what was wrong. For whoever keeps posting messages saying that they work for Cavalry and we are breaking the law all the time, you obviously are a liar. If you did work for us, you would know that calls are recorded and are being monitored by managers, site leaders, and auditors daily. There is no way you can openly break the law and get away with it anymore. At my site alone, eight people have been fired for FDCPA violations in the last two months. Bottom line is, the law is not being broken 99% of the time. You just don't like someone trying to get you to pay your bills.

Why would I have a Sprint cel phone debt outstanding from 4 years ago if I have worked for Beel Atlantic/Verizon for 20+ years. We get our cell phones for free. The bill they are trying to collect is from an address where I have never lived and they can easily figure that out too. They have called me and left me over 100 messages over the past year. I would be very happy to go to court with them. They are liars and they harrass people hoping they will pay if they do not own anything. They are bluffing about taking people to court. How could they without a contract or service statements showing your name and at a valid address? Do not cooperate with them. Do not talk to them. Do not give them any pesonnel information. Play games with them like they do with you. Hang up. Or better yet tell them you will be back in a minute and put the phone down. They deserve it.

I got a call from cavalry pre legal dept they said i owed a credit card bill from 2 yrs ago i refinanced my home last year and nothing was on their showing derogitory they they told me that they were going to seize my home i asked for proof that i owed the debt then she told me that if she sends me anything she would not settel my acct then she got very rude and hung up on me i called back and asked to talk to a manger and they transfered me back to her i told her i want the proof that i owe this debt and she can have the attorney call me if i am being sued any one who gets a call from cavalry ask for the proof first

My husband is in the military and had a sprit account 6 years ago, which he paid off when his contract was up. However, we just we to purchase a new car yesterday and applied for a loan through his bank. When he called to check on the loan to see if he was approved they told him that he had a debt for sprint for $30. The collection agency that has this debt is Calvary Portfolio. He doesn't owe anything on his sprint bill. Needless to say that because of this stupid crap we did not get the car loan from his bank. I know it is only $30 but this crap ruins peoples credit and makes them look like shit. We are going to take this to the fullest extent to get this off his credit or we are going to go about it the hard way. Life is too short to let people get over on you and screw your life up. If Cavalry is unjustly after you for a debt consider legal action. It could be very easy to win damages with a good legal firm that specializes in collection agencies. Buying debts from someone else is not a defense for improper behavior (as our MN Cavalry watchdog has implied a few posts earlier).

If you have a health problem such as hypertenion, arrhythmia, etc., you (or your heirs)could have a goldmine. Calvary has significiant assets. In some states (e.g. Massachussets (General Law c.269 s.14A) as little as 3 calls can be grounds for a harrassment suit. 50 or more will be a cakewalk. You can also include your State Attorney General for a "DO NOT CALL LAWSUIT" as well as the National Program. Cavalry is not exempt if the debt is not yours and they have used no due dillegence [which is usually the case with them}.
Document all activity with Caller ID service and a display unit. If it is LED and the data is subject to a loss of power or storage size use a camera to take a picture. Most cheap digital cameras will work fine. Many phone companies (especially cell phone)can give you caller id details on your monthly statement. Inquire about Call Trace Service (usually *57 )and other caller id services (*69 return call etc). Some are small extra fees but worth it when you win a law suit against Cavalry.
Cavalry uses multiple phone numbers and caller id blocking at different times. They are aware of the potential trouble they could have. Their automated messages will give their numbers depending on your responses to their questions. Be sure to get an audio tape unit for recording all of their calls. This may be an option on some answering machines. Automatic dialing systems with recorded messages are also illegal in many states and can results in additional fines above those of human telemarketers.
Do your homework. The lawsuits can be very satisfying. I am not an attorney, just another innocent victim.

The problem with what was stated above is that cavalry is well aware of the call limitations in Mass. Our phone system actually prevents us from calling Mass. The law actually states that we can not call and talk to you or leave a message more than 2 times in a 7 day period. We can call you up to 7 times a day if you never answer the phone. There is no such thing as a do not call list for debt collection. That is for telemarketers. You can send in WRITING a C&D. Going up the line, one $30 debt will NEVER prevent you from getting a car loan. You have to have other things for you to be denied a car loan. And if that $30 is all that was getting in the way, why didn't you just pay it? Who ever posted that I can't take the heat, I am not the one losing my temper. I have not wrtten one curse word or personnally insulted anyone. Yes, I have talked down to people. If you want to act like children, then you will treated as such. You want to play games on the phone and yell and curse, then you will be treated like a child. The person who claims to be an attorney, I hope you don't handle yourself in court the way you do here. If you say you didn't have an account, get mad at the original creditor for reporting a false debt or yourself for not doing something about it. Accounts don't get created on their own. Using the law to try and get out of paying will not work. What you are going to cause is a change in the laws to where you will have less and less rights. My attorney has advised me not to fill out a dispute form until I get their "proof of debt" in writing. Why should I let them correct bogus information? I want to go to court with the information they have.
I am collecting data on every call they make. I have contacted my state representative who co-sponsored the DO NOT CALL legislation. He is working to amend the law to treat Collection Agency as violaters if the debt is proven to be non-existant in a court of law. They will also amend the number of times per period and total times to make the same call from the same company. Computer controlled recordings will get additional penalties.

I do not live in Mass. I live in a much bigger state and it will be much harder for them to do business here when I am done.

Ihope the many others on this board who are being harrassed for debts they do not owe will take similar action. Together we can put them out of business. It is only right. They deserve it.

The person who stole my identity and got a cell phone did not want me to get an invoice because I would have called the phone company. Others on this board reported the same problem. Cavalry does not send copies of past bills out because they don't have your correct address on the bill They know this would not hold up in court. They want to scare and harrass innocent people into paying these bogus bills. They know there are many innocent victims. They just don't care.

A few tips from a previous collector:
It's so important to get any settlement or payment arrangements in writing before you make any payments; this goes for any company you might be dealing with. When you have finished paying as agreed, make sure to get another letter indicating that you have satisfied your obligation in full.
Check your credit reports regularly. If you antipicate going for any kind of loan or a mortgage, pull your credit reports as soon as you know. Do NOT wait until you get to the bank or car dealership. They don't always show you the reports they pull, and if they do, you can't always be assured that they haven't made "adjustments"(To "help" you qualify for their loan. While it might help you get a loan you might otherwise have not, it doesn't show things on your credit reports that the next creditor might not be so forgiving of). And if there is anything negative on your reports, it's usually too late to take care of them in time to get the loan when you were planning to.
Always check your credit report after you've satisfied an account. It usually takes 30-90 days for the credit bureaus to receive and process updates from the companies you've paid. If your reports haven't been updated properly, contact the company you've paid, as well as all three credit bureaus and dispute. Show them the letter of satisfaction.
If you receive a collection notice or see a collection account on your credit reports for something you didn't purchase and suspect foul play, contact the credit bureaus immediately and have a fraud alert placed on your credit reports. If the credit bureaus receive a copy of a valid police report, they have to block that account from being reported. You should then follow up with the company to see how they plan to help you resolve your dispute. Usually a fraud packet is involved.
KEEP ALL DOCUMENTATION. Keep as much as you can, for as long as you can. It might seem unfair to have to keep credit card bills and bank statements from 10 years ago, but it goes a long way in resolving disputes quickly and in your favor.
If you get a harassing call from a collector, contact the Better Business Bureau. Most collection companies respond pretty quickly to the BBB complaints.
If your dispute is not being resolved in a timely fashion, contact the BBB. They seem to get far fewer complaints than they should.
If you get a bill for something you believe you don't owe, call and ask for written documentation proving that you owe the bill. Sending a written request is always a good idea too. Ask for any and all documentation you believe to be relevant to your dispute, and don't settle until you have received what you asked for. Many times though, the company is unable to furnish the requested documents, and will "put you off" as long as they can. I've seen that happen over and over. But the smaller the balance, the greater the chance they will just close the account.
If you send a written cease and desist order (this can be worded in any way you see fit, as long as it's clear that you don't want that company to contact you anymore, but profanity usually leaves people scratching their heads, so try to at least be direct), the company can no longer contact you by phone or mail. The account will remain on your credit reports until paid, or disputed, resolved in your favor, and removed.
Am I going to be screamed at like all the other collectors that have posted here? I don't think I've said anything terribly controversial or upsetting, and I know how difficult it usually is to deal with these kinds of companies. It's horrible to be on the other end of the phone, with someone screaming at you, upset that they can't feed their children or pay their mortgages. I had someone threaten to kill me once. You're monitored very closely, and if you don't say the things they want you to say, or try to actually help people, you're usually canned. Needless to say, I'm no longer there.

i have been reading these comments and i have to agree that calvary is a horrible company. they have been calling me about a car that was repossessed. well i have never had a car repossessed. to you calvary employees, i answer my phone i return calls and i should not have to prove a debt is not mine when your company is obviously pulling names out of the phone book, phishing, trying to find an individual who has the same name. the first eight times i told them it was not me. they even gave me the last four of the other guy's social and i told them it was not me or my social. they said they would take me off their list, eight times, and i'm still getting calls every two to three days, and this is five months later. this is harassment through and through. if your company is so ethical, why don't you do some real research to find the people you're looking for rather than hound innocent people? i wish enough people out there could get together to file a class action suit against your company. you should 'prove' that you have the right person before you start harassing them. NOW STOP CALLING ME!!!!!!!!

My quess is that you were trying to sound like you caught us doing something that we did not do, IE break the law. What you are saying now is that you are trying to get the laws changed so what we are doing is illegal. That would mean that what we are doing is NOT illegal. All your doing is making credit harder to obtain in your state. When bills are harder to collect on, credit company's are less inclined to issue credit. In other words, if they don't have recourse, they will be less likely to take a chance on someone with a lower credit score. The "DO NOT CALL" legislation that your speaking of will be very difficult to change. The only way it got passed the last time was because they included a clause that exempted company's that you have previously done business with, like creditors. And no your debt did not come out of no where. Someone created it. If it was you or not is your responsibility to prove. If you were a victim of ID theft, do something about it. To the moron who supposedly works in our phoenix office, if you can't contribute something useful, shut up. I doubt you work for us anyway. ask for proof first that you do infact owe this bill do not give them any money untill they send you validation of debt and make shur that they have not tacked in intrest on the account good luck

Anyone being harrassed by this company
should contact the Fair Trade Commission,they oversee companies like
this,also contact the Attorney General's Office and file a harrassment charge against them. Be sure to send copy's of everything recieved by this company to them.

They have rules and regulations they
have to follow as found in the Fair
Debt Collection Practices Act.
They can only call you once in a 7
day period(any more than that it is considered harrassment).
They can only call a third party once and only once for information on you.
They cannot threaten you in any way.

You can write a cease and desist letter to the HQ. They are not supposed to contact you further after recieving the letter.
Be sure you send it return reciept
requested..they will have to sign for it..therefore they can't say they didn't get it.

I too had a Sprint account and since making many calls international I had to pay a large deposit. Then I closed my Sprint account only years later get a phone call from you guess Calvary. I tried contacting Sprint they said since it was so long to contact Calvary. Which of course I did and needed to send them a fax requesting the archives to show that I had paid this large deposit...guess again I still have yet to receive anything from Calvary. I don't have a phone since our home was destroyed in the hurricane and I work nights so I can't call them on the phone to discuss this further. All the people whom have responded on this website defending them because they work there what is a consumer to do if you follow the appropriate channels that were dictate by Calvary but get nowhere!

They want my banking information, I am reluctant to give it out, especially over the phone. We are also living in Canada now, does that affect the situation in any way? I don't even know where to turn to find out what my rights are.

Do not give out any of your information over the phone. There is a
statue of limitations on collecting a
debt by a Collections Agency, call a
lawyer to find out what your situation
might be (they don't charge for a phone call). If you have a legal aid
department in your Court House go to
them.

I believe I read that the limitation
was 7 to 10 years depending on the bill.

Write or call the Attorney General's
Office and file a complaint. They have
a form you can print out on their
web site.

You can file with the Attorney General's Office in your state.
Believe me they will investigate I've done it before. You can also
write the Fair Trade Commission and
file a complaint.

If enough people file against this
company maybe it can be shut down.

My husband and I just received a voicemail this morning from Cavalry. It took me several times listening to the message to even understand the name of the company. I called them back, and apparently we owe money for an old cell phone bill? This is news to me. I'm afraid to make a payment on it now, after reading all these messages. I don't know what to do, because I'm afraid I'll just be throwing my money away.

My suggestion would be to fax them another request for ALL documentation, not just a charge-off statement, showing that you owe the bill. Also, if you haven't already, ask for the open date on the account. It's possible that this is a new account that someone opened without your permission.
Try to resolve your dispute with the original creditor. Sometimes it's easier to do this, and if you have a letter of account closure, forgiveness, or satisfaction from the original creditor, the new company must close the account immediately. The company that owns your account now will tell you that you have to resolve the dispute with them, but it's a much more difficult route. That said, some of those cell phone companies can be really difficult to deal with.
If you make any payments on the account, it's considered accepting responsibility for the debt. Please don't expect to make a payment to just "make it go away." Once you've done so (therefore accepting responsibility for the account), it will be reported on your credit reports as a paid collection. There is usually very little one can do to have this removed.

You can decribe Cavalrys methods in item 2; You can indicate you are being harrassed by a Debt Collector in Item 3; and name them in item 6. You can go back to www.ftc.gov and review legislation and get contact information.

The FTC exists to protect the public. We can and will get the laws clarified/changed on Federal as well as State levels. Anything more than 3 calls to an innocent victim of identity theft is harrassment and Massachussets has wisely clarified this. The use of audio recordings on the phone is also not acceptable as in Washngton state.

Lets contact our representatives in the other States as well as on a Federal level. Most of our representastivs will be very glad to be advocates for innocent consumers. It is a no brainer. IT IS ALSO THE RIGHT THING TO DO.

For those people who say that if it's
on your credit report it must be your
debt,WRONG!..Because they use your SS
number to verify the debt WRONG!!

Case in point, It took me over two
months to clear my Husband's credit
report for bills that were my Son's.

My son's name is the same as his fathers,after his divorce he lived
with us for a year,hense our address
was associated with his bills.
Are you following this?

Two of the company's he owed put a
statement on my husband's report.
They didn't check age or SS numbers
to see if they had the right person,
they just saw the name and address
and assumed it was my husband.

I wrote both of the company's and told them I would sue them if they
did not retrack the statements from
my hudband's report,I also wrote all
of the credit report company's and
told them of the error.

Quess what? Now I'm getting calls from (you quessed it)Cavalry!!!
I sent them a letter with the last
known address and phone number of my
son,and was told three days ago that
the information was recieved and I
would not be getting any more calls.

I've had four more calls in the last
three days. SO MUCH FOR THEIR WORD.
I'm dealing with the AZ. offices.
I'm sending a cease and desist letter to each of them(certified with return reciept)informing them
that I will be sending a letter to the Attorney General's Office if I recieve any more calls from them.

For the person who said the Attorney
General's Office had better things to do than to listen to our grips.
IT'S THEIR JOB TO INVESTAGATE FRAUD!!
If your not doing anything wrong you
have nothing to worry about.

Sprint tried to charge me for using the internet for a WHOLE month. I never knew my phone was always online. I only used it once to talk to some friends on AIM and the I logged off. Later I was beginning to get IMs to my phone. I didn't know why, but I ignored them. I was over at a friends house where he said that my AIM was online. We sent my sn a message to see who the other person was. It was my cell. I signed on (my phone said I was signed off!), logged off AGAIN, and I was still online! I turned off my phone and turned it back on. We noticed that it logged me off. A few minutes later I was back on. I didn't have any automatic logon enabled. The bill came in a day or 2 later. I called sprint about the issue. I got my phone disconnected until they would "fix" my issue. What did Sprint do to "fix" my issue? They sent to me Cavalry. I talked to a bunch of people from Cavalry and told them my issue. "Ok, I can lower it from $500(?!?!?!) to $250"... what that representative meant was a FIRST PAYMENT of $250. I ignored his phone calls thereafter. Then another rep called to say that I can do payments... ok... but the low payments added back to the original $500... Never returned their calls... Someone else was doing the same thing, but now it was going to total $250 in 3 payments. Ok, no problem. I tried to call them back they were working my sleep hours. I got a final rep to take care of this and he told me that there were no notes of any lowered price. The only notes were that on my case was that I would make payments for $500... I would make payments for $250 now and then be charged another $250 down the line. This rep finally fixed everything so that all I owe is $250 PERIOD. I am going to pay it and then take Sprint to court for messing up my credit. Sprint never informed me that I was going to collections. I would call once a week to see what the status was. I always got "In process"... and then they didn't know what was happening... I went to collections. Thanks alot Sprint-turds!

I am not sure who all the people are on this BBS, but first let's understand a few things:

1) If you are delinquent on a debt, then someone will probably try to collect on it.

2) There might be some very legitimate reasons you are delinquent -- medical emergency, business loss, loss of employment, etc. Talk to a credit counseling company, but check their reputation first. If you are being harassed by creditors or collection agencies, you probably will want to get an attorney involved.

3) Know your rights under the Fair Debt and Collection Practices Act. If you have an outstanding debt that has passed that statute of limitations in your state, then you cannot be sued for that debt, no matter what anyone says. Furthermore, it is to your best interest 'not' to discuss this debt with anyone other than legal counsel, should you want to, because in some scenarios, it can reopen the statute date (though probably not -- best to be on the safe side).

4) If you choose, send a certified cease and desist letter to any collection agency to quit calling or communicating with your friends, family, employer, or yourself. They must respect this letter. Failure to do so can result in fines and even allowing your to sue them for harassment.

5) Once a debt is classified as delinquent and reported on your credit report, it stays on your credit report for 7 1/2 years, whether or not you pay it off, or settle. If you pay it off early, that will help your FICO score. If you settle, it will be reported on your credit report that you settled for less than the amount stated, but that the debt is resolved. Finally, if you have a very old debt, but where it is not at the 7 1/2 year mark, then paying it off might not be in your best interest. The reason is that once the debt comes off your credit report due to age, then your FICO score has increased. If you pay it is off or settle after it is off your report, it could re-appear, only to hurt your FICO score. So, you have to really be careful in this scenario -- see next item number.

6) Credit collectors come in all flavors. They are in business to try to collect on a debt. Some are reasonable, some are mediocre, and some are below rude. If you find that you are talking with a rude or mediocre or unreasonable collector, or anyone for that matter, just hang up the phone and send a cease and desist letter, certified mail with return receipt. Give it about 7 to 15 days to be processed. No one needs to be ridiculed or berated. Don't give in to the temptation of saying anything back.

7) Credit and collectors will mention that the call is being monitored and recorded. Request that it not be recorded. Remember: anything you say can be used against you.

8) Being delinquent on debt is maddening to most people. The vast majority of people are basically good, and want to pay their debts. However, circumstances do arise at times that can be financially debilitating. Remember: you must do what you must that is in your best interests. If the choice is between affording your medicine or succumbing to the threats of a bill collector, get the medicine. If it is a choice between paying the rent, or buying food, or affording your kid's daycare, do the obvious -- pay the necessities of life.

9) If you can pay something, then here is my suggestion. Get a third party involved. Bill collectors buy their debt often at 10% of face value, or less. If they get 50% of the face value, they are heroes to their company. A neutral third party that represents your interests can negotiate without emotion or the stress caused by the financial distress you are incurring. For example, if you can afford an attorney, they can help negotiate on your behalf. Whatever you tell your attorney is privileged. That means it is confidential, and your attorney cannot tell anyone what you tell him or her. They can help negotiate, or if you want, tell the bill collector to stop contacting you. Or, you can request that the bill collector only contact you through your attorney.

10) Credit counseling companies are in full force. They will be even more prevalent once the new bankruptcy law comes into play on October 17th. Check out the reputation of such firms with the BBB. Most will charge a fee. It should be in the neighborhood of $25 per month during the course of your debt consolidation and rehabilitation.

Lastly. Don't panic. Don't fret. Bill collectors will do what they do, just like you do what you do. Part of what they do is psychological gamesmanship. If you are not in a financial position to work anything out with them, then don't talk with them. However, at least send a cease and desist letter certified mail with a return receipt. And, again, I highly suggest, that if you can obtain legal counsel, do so. Perhaps you do not want to file for bankruptcy, and that is good. But you might still be financially insolvent. If you are, do not give up on your well-being for the sake of bad debt. At the same time, understand that whomever you owed the money to wants either to get repaid (preferrably) or to punish you by hurting your credit rating. Just do what you can, and the rest will fall into place. Just don't get emotional, or you 'will' make mistakes that could be costly.
