Now They Have My Correct Address

Called Juan this morning and gave him my right address (since they never had it to begin with). That way they actually know where to send my money back to.

In these days of 'buyer beware' we all as consumers have to understand that the claims of 'I've never had a .... account' or 'that's not me' are some of the most common excuses that debtors use with collection agencies. Therefore, we also have to understand that in many ways it is our responsibility as a consumer to prove it is NOT our debt, rather than the agency's issue to prove that it is. The sad fact of the matter is, the agency has the upper hand, and can with very little documentation, get a judgement against a consumer simply because of unwillingness of the consumer to cooperate with any investigation. Cooler heads prevail - calmly explain that you believe the debt is not yours, and ask for the steps necessary to clear this situation up. Again, the irate claims and ranting only lead the collectors to believe that you are simply angry that a debt collector has finally caught up to you, and the vicious cycle begins. Collections is not a pretty business, but most agencies are very careful to stay within the law to protect themselves. Be adult, and be prepared to resolve the issue calmly and carefully.

Just so everyone knows...according to federal law, the consume does NOT have to prove that the debt does not belong to them...it is the collection agency's responsibility to prove that the debt does indeed belong to the consumer. Read the Fair Debt Collection Practices Act. "Innocent until proven guilty" folks...

You're right. One of the most commonly committed crimes by debt collection services is actually imposing debt on the wrong person.
